To date, only certain companies have been obliged to prepare a non-financial statement under the CSRD Implementation Act. However, many companies have already opted to report on a voluntary basis to transparently communicate their activities and progress on sustainability matters.
The adoption of the Corporate Sustainability Reporting Directive (CSRD) into national law significantly expands the group of companies that are obliged to report. Gradually, large companies and groups without a capital market orientation, small and medium-sized capital market-oriented companies and companies from third countries with branches or subsidiaries in the EU will also have to publish information on their sustainability performance. In Germany ~15.000 companies fall under the application scope of the CSRD, prior it was ~500 companies.
To compare sustainability reports, the European Union has developed the European Sustainability Reporting Standards. These are mandatory for companies to comply with sustainability reporting requirements in practice. In addition, the complex requirements of the EU Taxonomy Regulation must also be implemented as part of the reporting on environmental impacts of business activities.
